General Terms and Conditions (GTC)

Clause 1
Scope of Application, Formation of this Contract

(1) These conditions regulate the business relationship between Jeremy Krauss (JK) and the respective participant of a training or advanced training course or another training programme of JK, unless otherwise agreed in writing between the parties to the contract.

(2) The training or advanced training contract comes into being when the participant accepts in writing, orally or through conclusive action the offer of JK of admission to a course offered by him or a corresponding course segment and JKA has finally confirmed the participation through written notification or through the sending of the course documents.

(3) JK is entitled to refuse or terminate participation in a course and thereby the training contract without stating reasons; in particular, if the necessary relationship of trust does not exist or it cannot be expected to be established, or if the participation or continuation of the training of the participant could lead to a moral conflict for that person. In this case, the entitlement to a fee by JK for the services arising up until the refusal, including the provision of course documents, is maintained.

Clause 2
Content and Purpose of the Training or Advanced Training Contract

(1) JK provides his services to the participants in the form in which he employs his longstanding knowledge and skills during the practice of the Jeremy Krauss Approach and the Feldenkrais Method for consultations and conducting of the courses and training sessions with the participants, taking into consideration any prohibitions on treatments and duties of care.

(2) The brochures published by JK and made available to the participants are a basis for the training content and an essential component for the respective contractual relationship. They provide detailed information on the methodology used.

(3) In the process, (new) methods are also used, that are possibly (still) not recognised as conventional medicine, but are commensurate with the state of scientific knowledge. These methods are generally causally and functionally explainable and in this respect therapeutically targeted and promising. However, a subjectively expected success of the methodology applied cannot be guaranteed.

Clause 3
Participant’s Obligation of Active Involvement

(1) The participant is obligated in principle to become reasonably actively involved in the training and seminar content. JK is entitled to break off training if the necessary relationship of trust no longer appears to be present, in particular, if the participant negates training content, provides necessary information inaccurately or incompletely or thwarts therapeutic measures that appear to be suitable.

Clause 4a
Binding participation, remuneration obligation

(1) JK charges a fixed fee (course or participation fee) for its service and participation in the training or further education event in the course offered. A corresponding remuneration agreement is concluded with the participant before the start of the training by signing the legally binding declaration of participation.

(2) The fee (for all courses and training courses offered) is to be paid in principle before the start of the course by transfer to the specified bank account for the entire course (in advance). An invoice will generally only be issued to the participant after the course has been completed.

(3) Payment is made exceptionally for each course segment, as described in the declaration of participation, if applicable. If the participant cannot take part in a course segment due to time constraints, the payment obligation for the missed segment still remains and, if necessary, will be credited towards a later participation in the corresponding course segment.

There is generally no reimbursement of course fees!

(4) The number of participants per course is always limited for the course offered in total and its respective course segments. A change to a different (later) course is only possible in exceptional cases if there is sufficient availability (space available) and with the consent of JK.<

(5) All required course documents (manuscripts, hand-outs, downloads, etc.) are included in the agreed course fee.<

Clause 4b
Service provision, force majeure

(1) The service is generally provided according to the “schedule” specified by JK when the contract is concluded. We reserve the right to change the scheduled dates for the respective course segments “for important reasons”.

(2) To the extent that JK prevents “force majeure” from providing the service, JK is not in default with regard to the obligation affected by force majeure and its obligation to fulfill or fulfill it on time is automatically suspended for the duration of the force majeure. Regardless of other provisions, “force majeure” does not apply to the obligation to make contractual payments.

(3) The term “force majeure” denotes events or circumstances of all kinds that
a) evade adequate control of the party invoking force majeure;
b) were neither effective nor foreseeable at the time the contract was concluded;
c) despite the immediate application of due care by the party concerned, it can neither be remedied, averted or otherwise overcome.

(4) Events of “force majeure” can in particular be:
a) natural disasters such as floods, earthquakes and similar accidents;
b) war, rebellion, hostility, invasion, hostile acts and civil unrest;
c) Travel warnings from the Foreign Office, restrictions due to court orders or official orders and official measures of overriding national interest;
d) other comparable, extraordinary events that cannot be avoided by JK.

(5) If JK is prevented from fulfilling a contractual obligation by “force majeure”, he will show the participant of the course the event or the circumstances that constitute “force majeure”, stating the obligations from which he is temporarily prevented from fulfilling or will be. This notice must be given within a reasonable period of time after JK becomes aware of the relevant event or circumstance has achieved to take place. After submitting this notification, JK is released from fulfilling this obligation as long as “force majeure” prevents it.

Clause 5
Invoicing, Payment Due Date

(1) The participant receives in accordance with Clause 4 Par. 2 an invoice (confirmation of payment) for each individual course segment. The invoice is suitable for presentation at the Tax Office or for your own safe-keeping and contains the name and address of JK as well as the name and the address of the participant.

(2) The due date of the course fees is determined, regardless of the invoicing, exclusively in accordance with the agreed payment dates for the respective course (training, advanced training, seminars, advanced seminars, etc.) or course segments .

Clause 6
Reimbursement of Fee by Third Parties

(1) In as far as the participant has or believes to have an entitlement to reimbursement or part reimbursement of the fee by third parties, Clause 4 is not affected by this.

(2) The participant acknowledges that costs of the training are not assumed by the statutory health funds (Statutory Health Insurance).

Clause 7
Confidentiality of the Participation

(1) JK always treats the participant data confidentially and provides no information in relation to consultations, his personal conversations or any suggestions for therapy as well as the attendant circumstances and the personal circumstances of the participant. The participant is himself responsible for the divulgence of personal data and information in respect of third parties within the course.

(2) The above paragraph is not applicable if JK on the basis of statutory regulations is obligated to pass on data or is liable to disclose information on the basis of an administrative order or court order. This also applies to information to primary carers, but not to information to spouses, relatives or family members. The same applies, if in connection with the training, consultation or therapy, personal attacks are made against JK or his professional conduct and he can exonerate himself through the use of relevant data or facts.

(3) JK keeps notes on his services (electronic participant files). The participant has the right to examine the file, but he cannot demand the surrender of this this file. The participant consents to the electronic processing of his data with the signing of the participant declaration.

Clause 8
Limitation of Liability, Guarantee

(1) JK is not liable for the success of a therapy, neither before nor after the conclusion of the passed course. A liability by JK is, as far as legally permissible, totally excluded for all therapeutic treatments or methodological information and statements.

(2) The participant, however, is not entitled to independently apply the learned methods prior to the conclusion of the course (graduation).

Clause 9
Consent to Collection of Data

(1) With the signing of the confirmation of participation, the participant declares his consent to his participant data and personal information being documented for statistical purposes, evaluated and anonymously stored by JK.

(2) Each participant must sign a separate declaration of consent on the use of his personal data (Confidentiality Policy Agreement) and of personal image or video material (“Photograph & Video Release Form”).

(2) Reference is made to the data protection declaration and the rights and obligations of the participant resulting from the General Data Protection Regulation [DSGVO] and the Data Protection Act [DSG].

Clause 10
Choice of Law, Legal Venue and Place of Fulfilment

(1) As agreed, German law applies exclusively for the entire legal relationship of the parties. As far is legally permissible, Munich is considered to be the agreed legal venue.

(2) Place of fulfilment for all services under the contract is always Rottach-Egern.

Clause 11
Severability Clause

Should individual provisions of the treatment contract or these General Terms and Conditions be or become invalid or void, the effectiveness of the training contract overall is not affected. The invalid or void provision is rather to be replaced in free interpretation by a provision that comes as close as possible to the purpose of the contract and the intention of the parties.

Allgemeine Geschäftsbedingungen (AGB)

§ 1
Anwendungsbereich, Zustandekommen des Vetrages

(1) Diese Bedingungen regeln die Geschäftsbeziehung zwischen Jeremy Krauss (JK) und dem jeweiligen Teilnehmer einer Aus- bzw. Fortbildungsveranstaltung oder einem sonstigen Trainingsprogramm von JK, soweit zwischen den Vertragsparteien nicht abweichend etwas anderes schriftlich vereinbart wurde.

(2) Der Ausbildungs- bzw. Fortbildungsvertrag kommt zustande, wenn der Teilnehmer das Angebot von JK zur Aufnahme in einen von ihm angebotenen Kurs oder ein entsprechendes Kurssegment, schriftlich, mündlich oder durch konkludentes Handeln annimmt und JKA die Teilnahme durch schriftliche Mitteilung oder durch Übersendung der Kursunterlagen final bestätigt hat.

(3) JK ist berechtigt, die Teilnahme an einem Kurs und damit den Ausbildungsvertrag ohne Angabe von Gründen abzulehnen oder zu kündigen; insbesondere dann, wenn das erforderliche Vertrauensverhältnis nicht besteht oder dessen Herstellung nicht erwartet werden kann, oder wenn die Teilnahme oder Fortsetzung der Ausbildung des Teilnehmers ihn in Gewissenskonflikte bringen könnte. In diesem Fall bleibt der Honoraranspruch von JK für die bis zur Ablehnung entstandenen Leistungen, einschließlich der Bereitstellung von Kursunterlagen erhalten.

§ 2
Inhalt und Zweck des Ausbildungs- bzw. Fortbildungvertrages

(1) JK erbringt seine Dienste gegenüber den Teilnehmeren in der Form, dass er seine langjährigen Kenntnisse und Fähigkeiten bei der Ausübung des Jeremy Krauss Approach und der Feldenkrais Methode für die Beratung und Durchführung der Kurse und Trainings bei den Teilnehmeren unter Berücksichtigung von eventuellen Behandlungsverboten und Sorgfaltspflichten anwendet.

(2) Die von JK herausgegebenen und den Teilnehmern zur Verfügung stehenden Broschüren sind Grundlage für die Ausbildungsinhalte und wesentlicher Bestandteil für das jeweilige Vertragsverhältnis. Sie geben detailliert Aufschlus über die angewandte Methodik.

(3) Dabei werden auch (neue) Methoden angewendet, die schulmedizinisch möglicherweise (noch) nicht anerkannt sind, aber dem Stand der Wissenschaft entsprechen. Diese Methoden sind allgemein kausal-funktional erklärbar und insofern therapeutisch zielgerichtet und erfolgversprechend. Es kann jedoch ein subjektiv erwarteter Erfolg der angewendeten Methodik nicht garantiert werden.

§ 3
Mitwirkungspflicht des Teilnehmeren

(1) Der Teilnehmer ist grundsätzlich in zumutbarer Weise zu einer aktiven Mitwirkung an den Ausbildungs- und Trainingsinhalten verpflichtet. JK ist berechtigt, die Ausbildung abzubrechen, wenn das erforderliche Vertrauensverhältnis nicht mehr gegeben erscheint, insbesondere wenn der Teilnehmer Ausbildungsinhalte negiert, erforderliche Auskünfte unzutreffend oder lückenhaft erteilt oder geeignet erscheinende therapeutische Maßnahmen vereitelt.

§ 4a
Verbindliche Teilnahme, Vergütungspflicht

(1) JK berechnet für seine Dienstleistung und die Teilnahme an der Ausbildungs- bzw. Fortbildungsveranstaltung in dem jeweils angebotenen Kurs ein fixes Honorar (Kurs- bzw. Teilnahmegebühr). Eine entsprechende Vergütungsvereinbarung wird mit dem Teilnehmer vor Beginn der Ausbildung durch Unterzeichnung der rechtlich verbindlichen Teilnahmeerklärung geschlossen.

(2) Das Honorar ist (bei allen angebotenen Kurses und Trainings) grundsätzlich vor Beginn des Kurses durch Überweisung auf das angegebene Bankkonto für den gesamten Kurs (vorab) zu entrichten. Eine Rechnung wird dem Teilnehmeren grundsätzlich erst nach Abschluss des Kurses ausgestellt.

(3) Die Bezahlung erfolgt ausnahmsweise für jedes Kurs-Segment einzeln, wie ggf. in der Teilnahmeerklärung beschrieben. Wenn der Teilnehmer aus zeitlichen Grunden nicht an einem Kurs-Segment teilnehmen kann, bleibt die Zahlungsverpflichtung für das verpasste Segment dennoch bestehen und wird ggf. kulanzweise auf eine spätere Teilnahme an dem entsprechenden Kurs-Segment angerechnet.

Es ist generell keine Rückerstattung von Kursgebühren möglich!

(4) Die Teilnehmerzahl pro durchgeführten Kurs ist für den jeweils angebotenen Kurs insgesamt und seine jeweiligen Kurssegmente stets begrenzt. Ein Wechsel in einen anderen (späteren) Kurs ist nur ausnahmsweise bei entsprechender Verfügbarkeit (Platzangebot) und mit Zustimmung von JK möglich.

(5) Alle erforderlichen Kursunterlagen (Manuskripte, Hand-Outs, Downloads, etc.) sind in der vereinbarten Kursgebühr enthalten.

§ 4b
Leistungserbringung, Höhere Gewalt

(1) Die Leistungserbringung erfolgt grundsätzlich nach dem von JK bei Vertragsabschluss vorgegebenen „Zeitplplan“. Änderungen der avisierten Termine für die jeweiligen Kurssegmente „aus wichtigem Grund“ bleiben vorbehalten.

(2) Soweit JK „höhere Gewalt“ an der Leistungserbringung hindert, kommt JK bezüglich der von höherer Gewalt betroffenen Verpflichtung nicht in Verzug und seine Pflicht zur Erfüllung bzw. termingerechten Erfüllung wird für die Dauer der höheren Gewalt automatisch ausgesetzt. Ungeachtet anderer Bestimmungen gilt „höhere Gewalt“ aber nicht für die Verpflichtung, vertragsgemäße Zahlungen zu leisten.

(3) Der Begriff „höhere Gewalt“ bezeichnet Ereignisse oder Umstände aller Art, die
a) sich der angemessenen Kontrolle der sich auf höhere Gewalt berufenden Partei entziehen;
b) zum Zeitpunkt des Vertragsabschlusses weder wirksam noch vorhersehbar waren;
c) trotz umgehender Anwendung gebotener Sorgfalt durch die betroffene Partei weder behoben, abgewendet oder anderweitig überwunden werden können.

(4) Ereignisse „höherer Gewalt“ können insbesondere sein:
a) Naturkatastrophen, wie Überschwemmungen, Erdbeben und ähnliche Unglücksfälle;
b) Krieg, Rebellion, Feindseligkeiten, Invasion, feindliche Handlungen und innere Unruhen;
c) Reisewarnungen des Auswartigen Amtes, Einschränkungen aufgrund von Gerichtsbeschlüsen oder behördliche Anordnungen und behördlichen Massnahmen von übergeordnetem nationalen Interesse;
d) sonstige vergleichbare, ausserordentliche und von JK unabwendbare Ereignisse.

(5) Wird JK durch „höhere Gewalt“ an der Erfüllung einer vertraglichen Pflicht gehindert, so zeigt er dem Teilnehmer des Kurses das Ereignis oder die Umstände, welche die „höhere Gewalt“ darstellen, unter Angabe der Pflichten an, an deren Erfüllung er vorübergehend gehindert ist oder sein wird. Diese Anzeige hat innerhalb angemessener Frist, nachdem JK von dem relevanten Ereignis oder den Umständen Kenntnis erlangt hat, zu erfolgen. Nach Abgabe dieser Anzeige ist JK von der Erfüllung dieser Pflicht befreit, solange die „höhere Gewalt“ ihn daran hindert.

§ 5
Rechnungsstellung, Fälligkeit der Vergütung

(1) Der Teilnehmer erhält gemäß § 4 Abs. 2 für jedes einzelne Kurs-Segment eine Rechnung (Zahlungsbestätigung). Die Rechnung ist zur Vorlage beim Finanzamt oder für die eigene Aufbewahrung geeignet und enthält Namen und Anschrift von JK sowie den Namen und die Anschrift des Teilnehmers.

(2) Die Fälligkeit der Kursgebühren richtet sich ungeachtet der Rechnungstellung ausschließlich nach den für die jeweiligen Kurs (z.B. Ausbildung, Fortbildung, Seminare, u.a.) oder Kurssgemente vereinbarten Zahlungsterminen.

§ 6
Honorarerstattung durch Dritte

(1) Soweit der Teilnehmer Anspruch auf Erstattung oder Teilerstattung des Honorars durch Dritte hat oder zu haben glaubt, wird § 4 hiervon nicht berührt.

(2) Der Teilnehmer nimmt zur Kenntnis, dass Kosten der Ausbildung durch die gesetzlichen Krankenkassen (GKV) nicht übernommen werden.

§ 7
Vertraulichkeit der Teilnahme

(1) JK behandelt die Teilnehmerendaten stets vertraulich und erteilt bezüglich der Beratungen, seine persönlichen Gespräche und eventueller Therapievorschläge sowie deren Begleitumstände und den persönlichen Verhältnissen des Teilnehmeren keinerlei Auskünfte. Für die Preisgabe persönlicher Daten und Informationen gegenüber Dritten innerhalb des Kurses ist der Teilnehmer selbst verantwortlich.

(2) Der vorstehende Absatz ist nicht anzuwenden, wenn JK aufgrund gesetzlicher Vorschriften zur Weitergabe von Daten verpflichtet ist oder auf behördliche oder gerichtliche Anordnung hin auskunftspflichtig ist. Dies gilt auch bei Auskünften an Personensorgeberechtigte, nicht aber für Auskünfte an Ehegatten, Verwandte oder Familienangehörige. Gleiches gilt, wenn in Zusammenhang mit der Ausbildung, Beratung, oder Therapie persönliche Angriffe gegen JK oder seine Berufsausübung stattfinden und er sich mit der Verwendung zutreffender Daten oder Tatsachen entlasten kann.

(3) JK führt Aufzeichnungen über seine Leistungen (elektronische Teilnehmerendateien). Dem Teilnehmeren steht eine Einsicht in die Datei zu, er kann diese Datei aber nicht herausverlangen. Der Teilnehmer stimmt der elektronischen Verarbeitung seiner Daten mit Unterzeichnung der Teilnahmeerklärung zu.

§ 8
Haftungsbegrenzung, Gewährleistung

(1) JK haftet nicht für den Eintritt eines therapeutischen Erfolges, weder vor noch nach Abschluss des bestandenen Kurses. Eine Haftung von JK wird, soweit rechtlich zulässig, für jegliche therapeutischen Handlungen oder methodischen Informationen und Auskünfte vollständig ausgeschlossen.

(2) Der Teilnehmer ist jedoch nicht berechtigt, die erlerneten Methoden vor Abschluss des Kurses (Graduation) eigenständig anzuwenden.

§ 9
Einverständnis über Datenerhebung

(1) Der Teilnehmer erklärt sich mit Unterzeichnung der Teilnahmebestätigung damit einverstanden, dass seine Teilnehmerendaten und persönliche Informationern von JK zu Statistikzwecken dokumentiert, ausgewertet und anonymisiert gespeichert werden dürfen.

(2) Es ist von jedem Teilnehmer eine sparate Einwilligungserlärung zur Verwendung seiner persönlichen Darten (Confidentiality Policy Agreement) und von persönlichem Bild- bzw. Videomaterial („Photograph & Video Release Form“) zu unterzeichnen.

(2) Auf die Datenschutzerklärung und die aus der DSGVO und dem DSG resultierenden Rechte und Pflichten des Teilnehmers wird hingewiesen.

§ 10
Rechtswahl, Gerichtsstand u. Erfüllungsort

(1) Es gilt auf die gesammte Rechtsbeziehung der Parteien ausschließlich deutsches Recht als vereinbart. Soweit gesetzlich zulässig, gilt München als vereinbarter Gerichtsstand.

(2) Erfüllungsort für alle Leistungen aus dem Vertrag ist stets Rottach-Egern.

§ 11
Salvatorische Klausel

Sollten einzelne Bestimmungen des Behandlungsvertrages oder dieser Allgemeinen Geschäftsbedingeungen ungütig oder nichtig sein oder werden, wird damit die Wirksamkeit des Ausbildungsvertrages insgesamt nicht berührt. Die ungültige oder nichtige Bestimmung ist vielmehr in freier Auslegung durch eine Bestimmung zu ersetzen, die dem Vertragszweck und dem Parteiwillen am nächsten kommt.
